Royal LePage Program Terms and Conditions

Go Lime has partnered with Royal LePage to offer certain complimentary services to: (i) sellers and buyers who complete a transaction through Royal LePage's brokerage services, and (ii) current employees of Royal LePage, (the "Program"). By requesting, scheduling, accepting, or receiving Services, you ("Participant", "you", or "your") agree to be legally bound by these Terms.

01.

Program Description

The Program is a promotional offering made available by Go Lime to Royal LePage to certain eligible individuals affiliated with Royal LePage. The Program provides limited complimentary residential HVAC preventative maintenance services, subject strictly to the Terms herein, technician availability, service area restrictions, operational limitations, and Go Lime's discretion (the "Services").

The Program does not constitute an HVAC service contract, maintenance agreement, warranty, insurance program, home inspection, engineering assessment, building compliance certification, or any guarantee of system performance or condition.

Scope of Services

Services will be arranged and provided by Royal LePage and are limited to basic maintenance services for residential HVAC and water-heating systems. Repairs, emergency services, parts, replacements, upgrades, or services beyond standard maintenance are excluded unless otherwise specified and may be offered at additional cost. Go Lime and Royal LePage reserve the right to modify, substitute, or discontinue services at any time.1

Excluded Services

Services performed under the Program do not constitute a certified home inspection, engineering advice, safety certification, code compliance inspection, warranty inspection, or professional consulting services.2

No Certification or Inspection

Unless expressly agreed in writing, the Program excludes: repairs of any kind; emergency service calls; diagnostic troubleshooting beyond basic maintenance; ductwork cleaning or repair; gas fitting, electrical, plumbing, or structural work; mold, asbestos, or hazardous material remediation; commercial or industrial systems; rooftop units; inaccessible equipment; code compliance inspections; permit-related work; equipment installation; smart-home integrations; indoor air quality testing; balancing or airflow engineering; and any work requiring specialized access equipment.

Additional Incentives

Eligible sellers, buyers, and employees of Royal LePage who elect to switch from their existing home-energy provider may qualify for promotional incentives, including gift cards.

06.

Eligibility

The Program is available only to active employees of Royal LePage and individuals who have retained the services of Royal LePage with respect to the sale or purchase of their residential property. Proof of transaction, employment, and/or agreement status may be required. All determinations of eligibility are final and made at Go Lime's discretion.

  • For added clarity, eligibility for incentives is conditional upon:
  • lawful termination or expiry of any prior agreement;
  • execution of a new agreement with Go Lime; and
    completion of a qualifying real estate transaction through Royal LePage.


Go Lime reserves the unrestricted right to verify eligibility at any time; request supporting documentation; refuse service where eligibility cannot be determined; and revoke participation for misuse, abuse, misrepresentation, or non-compliance.

07.

Appointments and Access

All appointments are:

  • subject to availability;
  • may be modified, postponed, or cancelled by Go Lime at any time;
  • must occur within Go Lime's designated service areas.


No guaranteed response time or appointment timeline is provided.

08.

Property Access

Participants must provide:

  • safe, unobstructed, and lawful access to the property;
  • access to all relevant equipment; and
  • a safe working environment for technicians.


Go Lime reserves the right to refuse, terminate, or suspend Services immediately where unsafe conditions exist; animals pose risk; equipment is inaccessible; hazardous substances are present; abusive or inappropriate conduct occurs; and in any other instance which in the sole and absolute discretion of the technician may pose a danger to them.

09.

Limitations & Exclusions

Promotional incentives are:

  • limited in quantity and subject to availability;
  • non-transferable, not redeemable for cash, and cannot be combined with any other offers;
  • not eligible for substitutions;
  • may be subject to minimum transaction values and closing requirements;and
  • will not be issued where switching violates the terms of an existing contract or similar obligation, or applicable law.3
10.

Privacy

You authorize Go Lime, its affiliates, and anyone else acting for Go Lime to collect, hold, use, exchange, and disclose your personal information for any of the following purposes:

  • to confirm your identity;
  • to administer and manage this Program;
  • to verify eligibility;
  • to communicate regarding appointments; to provide to our lenders; or
  • as otherwise required for the purposes of the Services contemplated under this Program or permitted by law.


You agree that we or our marketing partners may send information to you about products and services that may be of interest to you. You may withdraw your consent to these marketing messages at any time. You have a general right to access and rectify personal information about you that we hold. All matters surrounding our collection, use, and disclosure of your personal information are fully explained in our privacy policy, a copy of which is available on our website or upon written request to us.

11.

Force Majeure

Go Lime shall not be liable for any delay, interruption, deficiency, damage, loss, or failure in the performance or provision of any Services to the extent caused by circumstances beyond Go Lime's reasonable control, including but not limited to: acts of God; severe weather; flood; fire; epidemic or pandemic; public health emergency; labour shortages or disputes; strikes; lockouts; material or equipment shortages; supply chain disruptions; transportation delays; utility outages; internet or telecommunications failures; governmental actions, orders, or restrictions; changes in applicable law; civil unrest; war; terrorism; or any other event or condition beyond Go Lime's reasonable control (each, a "Force Majeure Event").

In the event of a Force Majeure Event, Go Lime may suspend, delay, reschedule, modify, limit, or cancel the complimentary Services or the promotional campaign, in whole or in part, without liability or obligation. Go Lime shall use commercially reasonable efforts to resume the affected services as soon as practicable following the cessation of the Force Majeure Event.

Nothing in this clause shall obligate Go Lime to provide substitute services, monetary compensation, or any other remedy arising from a Force Majeure Event affecting the promotional campaign or the complimentary services.

12.

AS IS Services

ALL SERVICES ARE PROVIDED "AS IS WHERE IS" AND WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, GO LIME DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING: MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, QUALITY, AND WORKMANLIKE PERFORMANCE.

13.

Release and Indemnity

Participant agrees to release, defend, indemnify, and hold harmless Go Lime and its respective affiliates, officers, directors, employees, agents, contractors, and representatives from and against all claims, losses, liabilities, damages, costs, or expenses (including legal fees) arising from participation in the Program; condition of the HVAC equipment; property access issues; pre-existing defects; third-party claims; or Participant's breach of these Terms.

14.

Governing Law

These Terms shall be governed exclusively by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute arising from these Terms or the Program shall be resolved exclusively by a court of competent jurisdiction located in Ontario, Canada.

15.

Entire Agreement

These Terms constitute the entire agreement relating to the Program and supersede all prior communications, representations, or understandings, whether oral or written.

  1. Complimentary Services may include routine inspection, filter replacement, standard servicing, and any such service that the technician deems appropriate in their sole and absolute discretion.
  2. No written or verbal comments made by technicians shall be interpreted as guarantees or professional certifications.
  3. Go Lime and Royal LePage are not responsible for any penalties, fees, or liabilities incurred as a result of terminating prior agreements. Employees must be actively employed at the time of fulfillment. Additional geographic and service restrictions may apply.
