Your Rights as an Ontario Homeowner When Your HVAC System Gets Red Tagged

Getting a red tag on your furnace, water heater, or any other gas appliance is stressful. The gas is off, the house is getting cold, and a technician is standing in your utility room telling you what needs to happen next. In that moment, it's easy to feel like you have no choice but to do whatever they say.
You have more rights than you probably realize. Here's what Ontario law and TSSA regulations actually allow you to do.
Right #1: You Can Ask for the Technician's Licence Number Before Any Work Begins
Every licensed gas technician in Ontario holds a TSSA certification either a G2 licence (for natural gas appliances up to 400,000 BTU/hr, which covers most residential work) or a G1 licence (for all gas systems). Before any technician touches your appliances, inspects your system, or issues a red tag, you are entitled to ask for their licence number.
You can then verify that licence at tssa.org. The lookup is free and takes less than a minute. If a technician refuses to provide their licence number or becomes evasive, do not allow them to proceed.
Right #2: You Can Get a Second Opinion
If your system has been red tagged and you disagree with the assessment or simply want confirmation before spending thousands of dollars — you have the right to contact another licensed gas technician for a second opinion. This is fully within your rights under the TSSA framework, and no company can legally prevent you from doing so.
If the second technician determines that the original red tag was issued incorrectly that the unit does not actually pose the safety risk that was claimed — you can escalate the disagreement to the TSSA for formal review. The TSSA has the authority to adjudicate disputes between technicians over whether a red tag was warranted.
Right #3: You Can Choose Any Licensed Contractor for the Repair
A red tag does not create an obligation to use the company that issued it. You are completely free to hire any licensed gas contractor to perform the repair and clear the tag. The technician who removes the red tag simply needs to be TSSA-certified and must document that the deficiency has been corrected.
This matters enormously in practice. A company that issues a red tag and immediately offers to replace your furnace at a premium price is not your only option. Get quotes from multiple licensed contractors before committing.
One thing you must never do: remove the physical tag yourself or turn the gas back on without official clearance from a licensed technician. This is illegal under Ontario's Technical Standards and Safety Act, voids your insurance coverage if something goes wrong, and puts your household at serious risk.
Right #4: You Can File a Complaint with the TSSA
If you believe a red tag was issued fraudulently, recklessly, or as a pressure tactic to force an equipment sale, you can file a formal complaint with the TSSA. The authority takes these complaints seriously. A licensed technician found to have issued a fraudulent or unjustified red tag faces disciplinary proceedings that can result in licence suspension or permanent revocation.
To file a complaint, contact the TSSA directly at tssa.org or by phone. Document everything: the technician's name, licence number, company name, the date and nature of the red tag, and any subsequent quotes or sales pressure you experienced.
Right #5: You Have the Right to Take Your Time
A Type A red tag means your gas supply to that appliance has been disconnected — it does not mean you must make a purchasing decision in the next hour. Yes, the situation needs to be resolved, but you are entitled to arrange temporary heating, contact other contractors, get multiple quotes, and make a considered decision.
Any technician or company that tells you the decision must be made right now, today, before they leave, is using urgency as a sales tactic. Legitimate contractors understand that a furnace replacement or major repair is a significant financial decision and will give you reasonable time to evaluate your options.
What a Legitimate Red Tag Process Looks Like?
- Technician provides licence number without hesitation when asked.
- Technician clearly explains what they found and can point to the specific deficiency.
- Red tag is issued if warranted, gas is disconnected if required, and situation is explained calmly without pressure.
- Technician provides a written report of findings and leaves you time to consider your options.
- Company does not immediately pivot to a sales presentation for new equipment.
- Company makes no objection if you mention getting a second opinion.
